On the Dojo copy rights list, it lists Ape inc. The only game that Ape ever made was Mother 2/Earthbound. There is no other character from Mother 2 that would get in before Ness.
There is still the possiblity of him being an AT. But I have evidence that this is not the case. The team that made Sin and Punishment is called Treasure Co. Ltd. They, among other teams who made games whos characters are Ats, are not listed in the copy right list. On top of that, next to the list it clearly states that the rights are for characters only.
Just something for you guys to think about.

I really want Ness playable too...but I don't think Mother will get two representives. And if they do...wouldn't they get somebody from the newer mother games(mother 3). Like Claus or Pokey(Porkey).

Interesting, it does seem to be a link. The only Earthbound mention on the site is when it talks about Ness in the Lucas character descriptions.
I wonder if the devolted fans at Starmen.net know about this, shouldn't they have picked up on this months ago?

Where are the copyrights listed on the site? The bottom? I need to check and see all the companies.

It also specifically says CHARACTERS right before it lists the copyright info. I think SA might've come up with something...

Yes, but as I said, the copyrights are for characters only. An assist trophy is still a character. Doesn't explain why Treasure isn't on there, but yeah.

A few helpful facts: Shigesato Itoi is an actual guy! He's an essayist who just happened to write the plot for the Mother games, not a company. Oh and Creatures Inc is actually a renamed APE Inc!
Either way, I'd also point out to those who say Assist Trophies count to the Character copyright... Stafy is owned in part by TOSE and TOSE isn't listed in the copyright... Also, Treasure doesn't own any copyright on Sin & Punishment... It's only copyrighted by Nintendo. I know, I OWN the game.

Treasure has a knack not only for producing fantastic games w/o sequels, but they also give whatever rights to the game they had to the publisher. Sega technically owns the rights to Gunstar Heroes and Dynamite Headdy while Nintendo gets Sin and Punishment and Wario World (IIRC). I guess by that logic, it explains why Pulseman didn't become a Nintendo property when they pretty much absorbed Game Freak. Or why Mischief Makers disappeared into the abyss (it had a few different publishers). And Ape became Creatures, but they still list it as Ape. Maybe the Mother 2 stuff is only copyrighted under Ape and didn't get transferred up to Creatures?
