This is an odd one. I think it's because the rom hackers were planning this huge "release" of their mods. Now, the question is, would this cause major issues with online play?
Maybe not. But the rom hacks weren't just fan creations - they were licensed characters from third parties and anime companies.
There's no such thing as freedom of expression in circumstances involving licensed characters. Frankly, I'm lucky NinDB is allowed to exist.

Frankly, I'm lucky NinDB is allowed to exist. Doesn't have the UK a fair dealing law, similar to the US' fair use? I don't know for sure. Since Germany doesn't have a law that allows publication of copyrighted content for educational purposes, also great Germany-based sites such as Planet Virtual Boy and 64DD.net which are internationally known can only exist thanks to Nintendo's tacit toleration. If copyright holders don't show tolerance, you have to close your site and maybe even to pay because of copyright infringement. Can be just because you showed copyrighted pictures. Anyway, I say again that we should all be lucky that Nintendo allows so much fan-made content.

Britain's fairly realistic about things like copyright law, but if Nintendo wanted to close down my website, I'm sure it wouldn't take them a lot of effort to do so. But the same goes for all websites. I'm sure the grand majority of them could be shown to be in breach of "fair use" somewhere along the line.

I would have pictured the issues with the hacks are because of the abuse to the engine and system people are doing. Wouldn't say, Mii parodies of people be dealt with before this, if licensing issues were the case?

After seeing how much attention these simple texture hacks to SSBB are causing, it's makes me wonder if Nintendo would consider to put a user generated texture/colour creation mode for the characters in the next game, so this doesn't happen in the future.
