It's not really piracy, when you think about it, everyone in Japan who wanted the game went and bought it and since the game never came out in the west no one (well, maybe a few hundred or a thousand or so people) bought it. Since this patch is only directed at anyone who reads english/people outside of Japan, Nintendo is not losing any money over it because they never spent money on the audience outside of Japan for this game.
Since this is a free patch and no one is gaining any money because of it and also because this project counts as fan art/fan work, Nintendo is not going to bother doing anything about it.
Nintendo is just probably accepting this as a slight mistake on their behalf after not relising sooning that the EarthBound/Mother fanbase probably would have bought the game if it was released outside of Japan.
Also should I have played Mother 1/EarthBound Zero and Mother 2/EarthBound before playing this game?

Earthbound Zero isn't important, but it is a direct sequel to EarthBound. Yes, play that before it.

The patch isn't piracy, but it is encouraging people to download the ROM which is piracy.
But then it's not like Nintendo gave us much choice in the matter. Teasing us with Brawl and not releasing the game - it's not like we're stealing money from them, because they weren't getting any in the first place.
I'm just waiting for the day an official release does hit the shelves, and there will be endless debates over how the fan patch is better, and how NoA does retarded translations, etc. etc...

Also should I have played Mother 1/EarthBound Zero and Mother 2/EarthBound before playing this game? I think you'll be fine. I would recommend Earthbound, but beyond that, you can probably understand most of what is going on.

I would recommend Earthbound, but beyond that, you can probably understand most of what is going on. To further this, the game stands on it's own till the end. The last hour or so of the game draws from EarthBound heavily, and doesn't make nearly as much impact if you haven't played it. Besides, EarthBound is just a great game. It's worth playing anyways.

It's okay to download and use the ROM if you have an official copy of the game itself. But asking for the ROM whether you have the actual copy of the game or not is still inappropriate. Speaking of translation, I heard that Tomato will translate Tomato Adventure after MOTHER 3 is finished. But will he? Source

Earthbound is great 'n all, but despite the rolling HP counter thing is still a pretty basic RPG, where you have to grind for experience every once in a while to beat a certain boss who can still defeat you because he happened to use a very hurting attack three times in a row. Still if you have time (and patience) I'd say play through Earthbound first. Speaking of translation, I heard that Tomato will translate Tomato Adventure after MOTHER 3 is finished. But will he? Sounds great! I've been willing to play through that game too, but there isn't a translation faq or anything as far as I know.

Thanks for the advice on what to play first guys, I will probably play EarthBound first. All I need to do now is hope it's the 300 VC game, I really don't want to use an emulator to play it (yes I know I will be doing so for Mother 3). Also it's nice to hear about Tomato Adventure possibly getting translated, even though they hinted at doing it to Mother 1+2 (on GBA) as well. But I would prefer they didn't consideing those are already in english.

If you want the full experience, play Mother, then EarthBound, then Mother 3. If you're not bothered, you can play EarthBound without playing the others. I would actually rather EarthBound was retconned as Mother 2, just to stop people saying EarthBound Zero (fan name) and EarthBound 2 (which I have never heard anybody say before until now).

Anyway, someone mentioned that Lucas's section of the SSE is basically one huge spoiler for Mother 3. But all Lucas's section consists of, is running away from a giant Porky statue. How exactly could that be descibed as spoilerish?

Because geezer Pokey shows his face.
In the game they mention him as 'the great one' and such and it isn't until near the end you see statues and whatnot of Ness' annoying kid next door and you realise that 'holy shit HE's behind all this?'. And then when you actually see him in person you're surprised he's some old paralyzed fart now. If you already know about this it obviously ruins the 'woah what the hell' moment.
