The ownership of a property isn't that simple without having the original agreement between the companies. But EBA/Ossu are Nintendo published games (with Nintendo references in, no less). It's highly likely that Nintendo put a lot of money towards the Western remake. In short - until proven otherwise, it's a Nintendo property.
Not to say it won't BECOME a third party property in the future - but then so did Banjo-Kazooie and Animal Leader.
There's nothing stopping EBA/Ossu appearing in Brawl. And they would make an AWESOME assist ;D

So no, I don't think we'll even see the Elite Beat Agents as Assist Trophies, let alone playable characters. Every time you say or even think this, one of the 3 you want dies. Black Shadow is now gone, can you afford to risk the fate of the other 2?

Also don't forget the semi popular international guys: Pikmin, Ray MK, Little Mac,Someone from Wars series, Duck Hunt Dog. Dont´t you think they got more chances that the Japan only characters (maybe Duck hunt Dog its stretching it a bit) Not in my book! Duck Hunt Dog is one NES character I've been supporting since 2002 when I first came up with the idea for the next Smash game after Melee. ;D I know he don't have great chances of being playable so I'd settle for him as an AT.

I think we will see a lot of Japan-only characters as ATs with a few (maybe 2-5) Japan-only playable characters: Marth, Lucas, Takamaru, Sukapon, or Stafy. And yes, the dog's laugh would be priceless. If he was playable, that would be the perfect taunt. ;D And with the online play, if he was playable, I would have him say "You fail, LOL"

I'd like it better if the dog flushes out ducks from the background and then the ducks are being shot at. Anyone who gets shot would be killed instantly, prompting the dog to come out to laugh at their misfortune.

Laughing dog, man! he's a classic. Nintendo should not skip his representation, also Mario's first girlfriend Pauline should be in Brawl (palying a role like Palutena and maybe as an alt costume and having her own "special" trophy too)
Marin could be a Zelda alt too. I also think Medusa should be a boss like Petey Piranha

He would even be in the playing area... he's be in the background back with Pokemon trainer... so no matter how badly you want to beat his ass... you can't.

Anyone who gets shot would be killed instantly I think that would be just a bit unfair in my opinion. It would be OK if they were damaged (say 10% per hit) , but not an instant KO.

I believe that Takamaru, Stafy, Skapon and DeMille are the Japan-Only characters that have the best chances at appearing in SSBB. Most likely, not every one of them will enter, but at least one of these four will appear. DeMille is popular, but not very popular, making his chance at appearing in SSBB smaller. However, if Chihiro Fujioka (producer of Super Mario RPG, Final Fantasy Legend III and several AlphaDream titles) and Square-Enix don't want Sakurai to add Geno into SSBB as anything, then Chihiro Fujioka might let Sakurai use DeMille from Tomato Adventure instead, because |1.| DeMille was mentioned twice in Sakurai's SSBB poll, |2.| Tomato Adventure is the only Nintendo-published title produced by Chihiro Fujioka that isn't a Hamtaro or Mario title, and |3.| DeMille has a large amount of moves for Sakurai to choose from, including some that look similar to the Final Smash moves. Just because Geno appeared in M&L: SS, doesn't mean he'll enter SSBB. He was added as a reference to Chihiro Fujioka and his works (including M&L: SS and its sequel), just like one of the costumes of Jill in Drill Dozer being a reference to Pulseman. I understand that Geno is one of the most-wanted characters for SSBB, as well as one of the most popular Mario characters, but here are some things that will decrease his chance at entering SSBB: * He is 3RD-Party (duh!). Even though Sonic, Solid Snake and some of their friends and foes are in SSBB, I assume that Sakurai will only let SSBB represent two 3RD-Party franchises. Of course Geno is more than a 3RD-Party character, which he is also a Mario character, but read these next two things. * He probably won't look good in SSBB without Mallow or any other original character from Super Mario RPG: Legend of the Seven Stars. AND * SSBB has enough Mario characters. There were four Mario characters in SSBB, excluding clones and characters that are more than Mario characters, which is perhaps the largest amount of SSB characters a franchise could get. I'm neither a Geno fan nor an anti-Geno person or whatever, but these are my predictions. Now for Stafy. He still has a chance at entering SSBB. Even though he wasn't mentioned, neither was Pokemon Trainer nor any of his three Pokemon. If popularity seriously means everything, then Stafy is a good choice. If Sakurai adds Takamaru in SSBB, then that wouldn't complete the Famicom Disk System line-up, because there is also Donbe (and perhaps Hikari), the main character(s) of Nintendo's first text-based video game, Shin Oni Ga Shima, which became popular and was released again for the Famicom Mini series and the Virtual Console. Also, Donbe was mentioned in Sakurai's SSBB poll only once. When Donbe is young, he fights with a straight, y-shaped stick. When Donbe becomes older, he uses a katana. Donbe (and perhaps Hikari) are good choices, but their chances at entering as a playable character are quite slim, but they sure do have a good chance at appearing as an Assist Trophy. Finally, for Skapon, he might not enter, because of Sakurai previously saying that Skapon will not appear in SSBM, and probably will not appear in the next SSB title (SSBB). However, fans of Skapon / Joy Mech Fight never gave up, and posted more Skapon requests in Sakurai's SSBB poll. Two of them appeared, which might make Sakurai say something like "Okay, but if I face a single major problem while developing him, I will not add him. However, I might add him as a regular Trophy."

Stafy would be perfect! Judging from the game trailers on YouTube, I'd say the starfish has plenty of moves that can be incorporated into his Brawl moveset! and he's pretty popular in Japan if he has 4 games out. But no one voted for him in Sakurai's Brawl poll..... That might hurt his chances.
Lip would be awesome. She's "combat ready" despite we never saw her physically fighting. But we know her stick can be used as her main weapon. And she would add to the low female population the game has. And she could maybe use her spatial-switching and block-dropping powers for her moveset. Plus she was the #2 most-wanted Japanese character (#1 was Sukapon) in the Melee poll and had 2 votes in the Brawl poll. But the fact her stick is an item might hurt her chances. But I don't think it should be an issue. Link, Ike, and Meta Knight could hold two swords at the same time (their own sword and the Beam Sword) so Lip holding two sticks shouldn't be an issue.
Sukapon pretty much is unlikely to be playable anyway. Sakurai seems to be against him being playable in Smash Bros. for some reason. So moving on...
Takamaru might work. But he would be just another sword-fighter in addition to Link, Meta Knight, Ike, and maybe Marth and Young Link (if they come back). So he would need to be original with half of his sword-based moves to make himself distinct enough from the other sword-fighters.
